Drugs and medicines are often the center of product liability suits. Manufacturers of these products must be the appropriate test drugs and medicines before releasing them into the market. The Food and Drug Administration (FDA) has set standards for drug testing. These criteria are considered standard, but the fact that the drug was properly licensed FDA has no effect on the manufacturer's warranty to the plaintiff's injury if the product proves to be otherwise defective.

In those cases, injuries and damage is not apparent until the children reach maturity.
In such cases, various theories may be available to shift the burden on potential defendants to prove that they had not received the drug in question, or to allocate damages among a number of potentially responsible producers. The National Childhood Vaccine Injury Act was established in 1986 to provide a remedy to individuals who have been injured because of mandatory vaccination of children. The law provides no-fault administrative compensation instead of suing vaccine manufacturers when certain vaccines cause injury or death.
